Terms of Service

By creating an account or using any part of the SwapSmart platform, you confirm that you are at least 18 years old, a current social housing tenant in the United Kingdom, and that you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

SwapSmart is exclusively for social housing tenants in the UK. To use the platform you must:

• Be a current council or housing association tenant
• Have permission from your housing authority to pursue a mutual exchange
• Provide accurate tenancy information during registration
• Not be subject to active possession proceedings or injunctions

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at hello@swapsmartapp.co.uk if you suspect unauthorised access to your account.

When using SwapSmart, you agree not to:

• Provide false, misleading, or inaccurate information about your property or tenancy
• Use the platform for any unlawful purpose or in violation of housing legislation
• Harass, abuse, or threaten other users through the messaging system
• Attempt to bypass or circumvent any security features
• Scrape, copy, or commercially exploit any content from the platform
• Create multiple accounts or impersonate another person

SwapSmart facilitates the discovery of potential mutual exchanges. We do not guarantee that any match will lead to a completed swap. All exchanges are subject to approval by the relevant housing authorities and must comply with your tenancy agreement. SwapSmart is not a party to any exchange agreement between tenants.

All content on the SwapSmart platform (including design, text, graphics, and software) is the intellectual property of StackWave HQ Ltd or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

SwapSmart is provided on an "as is" basis. We make no warranty that the platform will be uninterrupted, error-free, or free from viruses.

To the fullest extent permitted by law, StackWave HQ Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to lost savings, failed exchanges, or data loss.

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through a notice on the platform. Continued use of SwapSmart after changes take effect constitutes your acceptance of the updated terms.

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
